Labour Hire Industry Regulation in Queensland

Apr 27, 2018

The Labour Hire Licensing Act 2017 (Qld) commenced on Monday 16 April 2018, and requires providers of labour hire to other entities in Queensland to be licensed.

The Act establishes a mandatory licensing scheme. Key features of the Act include:

  • Labour hire providers must be licensed to operate in Queensland
  • Persons/Companies who engage labour hire providers to only engage licensed providers
  • Labour hire licensees to satisfy a fit and proper person test to establish that they are capable of providing labour hire services in compliance with all relevant laws
  • The labour hire business is financially viable.
  • Licensees must provide six monthly reports on labour hire and associated activities including accommodation, and in relation to compliance with relevant laws
  • Strong penalties for breach of obligations
  • Establishing a labour hire licensing compliance unit with a field services inspectorate with responsibility for awareness, monitoring and enforcement functions.

For more information on the Queensland labour hire licensing scheme visit the following website labourhire.qld.gov.au. It provides information about the scheme and rights and obligations for labour hire providers, users of labour hire and workers.

What must you do now?

Labour hire providers caught by the regime have 60 days from the commencement of the legislation to apply for a licence.

The Act provides very high penalties (up to $378,000 for corporations) for breaches.

Any business providing or utilising labour hire arrangements must:

  • Scrutinise the arrangement and the new rules and establish whether the entity providing the labour hire must be licensed; and
  • If licensing is required, apply before Friday 15 June 2018.
